I, understand that this is a marketing Contract between myself herein referred to as “the Seller” and Private Real Estate Corporation also trading as PrivateRealEstate.ca and The Private Real Estate News herein referred to as “Private Real Estate”. No Agency is created or implied by this Contract. Private Real Estate is not a real estate company licensed under the Ontario Real Estate Act. Private Real Estate can not and shall not provide any services for which a license is required under the Act.  Private Real Estate shall not negotiate on behalf of the Seller or anyone else in the sale and purchase of the land and/or improvements that are subject of this Contract, nor shall it offer any legal advice in general and as to the validity/viability of any offers generated thereby in particular. The Seller is encouraged to seek legal opinion prior to accepting any offers to purchase that may result from this Contract.  In return for good and valuable marketing services provided by Private Real Estate, the Seller agrees:

1. To notify Private Real Estate Corporation immediately once the property is sold or listed elsewhere as it is subject to removal from our service.

2. In the event that the property is sold the Seller agrees to display a Private Real Estate SOLD sign for a minimum of 14 days.

3. That all signs, frames, info boxes and other advertising media provided to the Seller are and shall continue to be the property of Private Real Estate and that the Seller or their agent may not affix anything to, or amend and/or alter any Private Real Estate signs, frames, info boxes or media in any manner whatsoever.

4. That during the term of the Contract the Seller will be wholly responsible for, and within 24 hours of giving notice shall return, all signs, frames, info boxes and other advertising media provided by Private Real Estate.

5. That the use of all promotional materials, including without limitation Private Real Estate logos, signs, frames, info boxes, advertising media, brochures, handouts, etc. are restricted for use on the property described in this contract.

6. To pay for the listing package selected above prior to or no later during the appointment with a Private Real Estate representative.

Refund Policy - If you do not sell your property using our services we will give you your money back! In order to receive your money back the following 8 conditions must be met -

1) Property must sell through an agent/mls for no less than was advertised with Private Real Estate in the last 60 days, in a time frame of no more than 90 days post de-listing with Private Real Estate. 
2) Last price must be advertised for a minimum of 60 days with Private Real Estate otherwise the initial listing price will be considered.
3) Property must be listed with Private Real Estate for a minimum of 90 days, and may not be re-listed at a later time. 
4) At no point whatsoever can the property be listed with a Real Estate Agency and Private Real Estate at the same time.
5) Private Real Estate MUST be notified 24 hours prior to listing with the agent, at which point all signs and promotional material must be returned.
6) The seller must display the Private Real Estate “Private Sale” sign at all times during the listing period with Private Real Estate.
7) Refunds shall be limited to the cost of the Regular Package plus HST.
8) Proof of completed sale, and agency listing contract shall be required.

Delivery Policy - Once you place your order we will have your home listed within 24 hours.  This allows us time to come to your home to take photos (if necessary).  If you provide us with photos in electronic format we will have your home listed quicker.
